Drafting

We are experienced in, amongst others, drafting policies and procedures, handbooks, self employed contracts and contracts of employment. Every employee is entitled to receive a statement of their main terms and conditions of employment under section 1 of the Employment Rights Act, so we provide everything from the basic template designed to meet the minimum standards required by law to those that are individually tailored to meet the exact requirements of your business. The contract will be the starting point for most issues and disputes and therefore it is important to get it right.

Advice
Employment law and HR can be a confusing area, so we are on hand via the telephone, email, or by letter to offer you simple, straightforward advice. We will provide you with all the options and indicate the consequences and benefits of each. We will not tell you how to run your business but will outline your options clearly and free of any legal jargon. We will provide our opinion without sitting on the fence but assist you with whatever decicion you make.

Representation
If you are unfortunate enough to have an Employment Tribunal claim raised against you we can see the case through to the end. We can negotiate settlements and draft compromise agreements or fight your case in an Employment Tribunal. If you decide to defend a claim we will deal with all correspondence relating to the claim on your behalf and will prepare for and represent you in the Employment Tribunal. We are not in the business of providing advice and then leaving you to fend for yourself at a Tribunal.

As all our consultants have the requsuite experience and qualifications to provide all legal services, we do not need to engage counsel or seek opinions elsewhere. This keeps your costs down whilst ensuring that the person who has dealt with your case on a day to day basis is there to represent you at the Tribunal.

Fixed Fee

We have seen how the costs of legal advice and representation can spiral out of control. We always quote you a fixed fee, which is agreed in advance. This way there are no hidden extras.
Once you have been quoted a price - that is the price you will pay.
This ensures all our clients are certain of their fees and your case will be dealt with as swiftly as possible, rather than being delayed to increase costs! This way we ensure that Accountax Employment Law certainly is value for money!


Hourly Rate

Of course, our hourly rate is still available if for your preference.


Retainers

We understand that many appreciate the security of having someone on hand to answer any questions and queries from the relatively simple to the more complex, mind-boggling ones! We therefore provide an annual employment law advice retainer.

You pay a one-off fee based on the number of people you employ and then we are at your disposal for 12 months to provide advice on a wide range of employment law matters.

The annual retainer includes advice relating to:
Disciplinary and Grievance procedures
Redundancy procedure and calculation of statutory redundancy pay
Implementing variation to terms and conditions of employment
Part-time workers
Maternity leave and returning to work following maternity leave
Statutory sick pay
Managing absenteeism and ill-health
Statutory leave requirements and entitlements
Flexible working and handling requests
TUPE
Whistleblowing
Working time regulations
Employment agency regulations
HGV drivers' regulations
General employment matters

Retainer clients also receive:
Regular updates on developments in employment law
Letters of advice to you and precedent letters to send to employees for matters covered by the retainer
Compromise agreements (limited to one per year within retainer fee)

20% discount on our employment law products not covered by the retainer

The annual retainer excludes the following:
Health and safety advice
Drafting and amending handbooks, policies, contracts, court pleadings
Representation and preparation for hearings in the Employment Tribunal, Employment Appeal Tribunal, and Tax Tribunal
Visits to our and/or your office premises for any reason connected with legal advice
Self employed workers and their contracts, status issues and holiday pay claims
Due diligence


Tribunal Retainers
We also offer a tribunal retainer. Rather than paying for legal advice for each claim raised against you, we can deal with all correspondence, preparation and representation for an agreed number of claims per year. There would be no further fees or negotiations.
